Competitive Advanced Program Agreement
Marx Fencing Inc. dba Marx Fencing Academy, hereinafter “MFA”, provides the Competitive Advanced Program as a ten-month elite level training program (from September 5th, 2023 until the commencement of Pre-Nationals camp in 2024) with the intention of training for the collegiate, national, and international levels of competition. Enrollment in this program is a contractual obligation to finish the program in full and students (including signatory parents and guardians) are responsible for payment of all tuition and related fees through the end of the program even if they withdraw prior to the end of completion of the program.
Annual Membership:
The Level III Annual MFA membership is valid for 1 year starting the date of purchase. MFA annual membership fees are not subject to reimbursement in any case. Enrollment in the competitive advanced program requires a Level III Annual MFA membership and a competitive membership with USA fencing.
Classes and Bouting:
Competitive Advanced members have unlimited access to classes and bouting sessions until the commencement of Pre-Nationals Camp in 2024.
Lessons:
Competitive Advanced members have access to their selected lesson package until August 1st, 2024. Any remaining lessons after August 1st, 2024 will be subject to staff availability and approval.
Cancellation and missed lessons:
A private lesson that is canceled less than 24-hours prior to start time is considered a "Late Cancel" and will be counted as a lesson taken from their lesson pack.
A lesson that is booked but not attended is considered a "No Show" and will be counted as a lesson taken from their lesson pack.
Withdrawal from Tournaments:
Students who register for tournaments will be assessed coaching fees based on the number of events they participate in. If a student wishes to withdraw from any given event, they must notify in writing to the MFA coaching staff and the front office the events that they have withdrawn from. Coaching fees will still be assessed if the student does not withdraw by the tournament’s official withdrawal date.
Definitions:
Annual Membership Fee: The fee charged to each athlete to offset the administrative costs and expenses incurred by MFA in the operation and management of their programs. In this instance, it is the Level III Annual Membership fee.
Tuition Fee: The fee associated with the purchase options related to classes and lessons of the Competitive Advanced Program.
Length of Season: The season begins on September 5th, 2023 and ends on the commencement of the Pre-Nationals Intensive Training camp in 2024.
Season Ending Injury: An injury will be considered “season ending” when a licensed physician determines that due to an injury a fencer cannot participate in the remainder of the on-going season and/or the up-coming season. The physician’s determination of a season ending injury must be in writing and addressed directly to MFA or otherwise subject to verification.
Policy:
MFA is committed to providing our fencers with the unparalleled opportunity to enhance and develop their knowledge and skills in order to meet their individual fencing goals. MFA recognizes that obtaining quality training and coaching are all key components to support our athletes’ fencing careers. We also realize that at times, injuries may play a role in a fencer’s path of reaching their goals. In the event of an unfortunate season ending injury, this policy provides the requirements and process to potentially obtain a reimbursement for a portion of the tuition that is paid to MFA for a fencer participating in the Competitive Advanced Program in the event of a season ending injury. Any approval of any reimbursement will be governed by and subject to this policy.
Tuition fee reimbursement is only offered in accordance with the rules and conditions outlined in this policy. MFA reserves the right to update, modify or terminate this program at any time without binding itself or fulfilling any specific course of action from past or future commitments. MFA shall not be obligated to approve any request for a tuition reimbursement based upon any other reimbursement decisions made for the benefit of the same or different players. Each request for tuition fee reimbursement shall be evaluated for eligibility based upon the current facts and circumstances. MFA shall have sole and final authority to make all decisions regarding the approval or denial of any athlete fee reimbursement request.
Late Payment
Participants with negative balances may be unable to book any MFA services until the balance is resolved.
If you do not have a credit card on your account and/or if it is declined, your account will be charged and show a negative balance. The member will be required to balance the account upon the next visit.
If the negative balance is not resolved within 1 month from notification, the member’s account will be frozen and the member will be ineligible for all services. A late fee of $50 will be assessed to reactivate the account.
Eligibility:
All requests for reimbursement must satisfy BOTH of the following conditions.
The fencer has suffered a season ending injury; AND
The fencer is current on the payment of tuition fees.
Procedure to Submit Request:
To Submit a request for tuition reimbursement the fencer’s parents should fill out the MFA’s “Reimbursement Request for Season Ending Injury” form, this document can be found on the MFA’s website. The completed form should be submitted to Injury Reimbursement Request. In order to complete the form, the injured athlete/fencer must be evaluated by a licensed physician. The licensed Physician must determine that the fencer's injury will prevent the fencer from participating in the remainder of the ongoing season or prevent the participation in the up-coming season. The licensed physician’s determination of a season ending injury shall be attached to the completed Reimbursement Request.
Prorated Reimbursement:
Eligible fencer tuition fee reimbursement will be made on a prorated basis based up the remaining time left in the 10 month contract.
Reimbursement date will be set from the final determination of injury from the note of a licensed physician.
Injuries that occur in the final two months of the contract will not be reimbursed.
Fencer shall not be eligible for refund of any amount of the annual membership fee.
Ineligible for Reimbursement:
Fencers tuition fees will not be reimbursed by MFA for any of the following reasons.
Fencers Voluntary Cancellation: If a fencer voluntarily cancels or withdrawals from participation with MFA for any reason are not eligible for a refund or credit.
Voluntary cancellations would include cancellations unrelated to a season ending injury and may include all personal reasons such as changing club membership, moving from the state, or other family events which may prevent the fencer from participating.
Dismissed Fencer. A fencer who is dismissed or removed from MFA by the management staff for disciplinary reasons will not be eligible for a refund of any of the fencer's tuition fees. All fencers may be subject to disciplinary action, including but not limited to dismissal by the lead coach for any behavior that is not compliant with MFA rules and code of conduct or behavior which is deemed dangerous to other fencers. After a lead coach has made a decision to dismiss or remove a fencer, such fencer is not eligible for any refund.
Exclusions from the reimbursement policy:
This reimbursement policy will not extend to reimbursement of fencers tuition resulting in whole or in part from, or contributed to by, or as a natural or probable consequence of, any of the following:
Suspension of the fencer for all or part of a season for disciplinary reasons.
A fencer's inability to participate due to loss or injury caused by consumption of alcohol or non prescribed medication.
Voluntary cancellations would include cancellations unrelated to a season ending injury and may include all personal reasons such as changing club membership, moving from the state, or other family events which may prevent the fencer from participating.
Fencers decision to quit participation with MFA for any reason.
Fencers temporary inability to participate due to vacation, family emergency, illness, non season ending injury or other reasons.
All late fees are non refundable.

I have read Marx Fencing Academy's tuition policy for the competitive advanced program and agree to its terms. I am knowingly signing a binding 10-month contract and am aware of my contractual obligations. Payments will be made via lump-sum or payment plan using the credit card on file.
